By using FixPit you agree to these terms. Please read them carefully before requesting a service or registering as a mechanic. Versión en español.
1. What FixPit is
FixPit is a platform that connects customers with independent mechanics for at-home automotive services. FixPit facilitates the connection, communication and payment, but does not provide the mechanical service and is not the repair shop: the work is performed by independent professionals who maintain their own licenses and insurance. FixPit does not guarantee the quality, safety or results of an independent mechanic's work.
2. Eligibility
You must be at least 18 years old and legally able to enter into a contract to use FixPit. By using the platform you confirm that you meet these requirements.
3. Use of the service
- You must provide truthful information when requesting a service or registering.
- You are responsible for your account and the activity carried out under it.
- You may not use the platform for unlawful or fraudulent purposes.
4. For mechanics
- Mechanics receive 85% of the price of each completed service; FixPit retains 15% as a commission.
- Mechanics operate as independent contractors, not as employees, agents or representatives of FixPit. Each mechanic is responsible for their own taxes, tools and expenses.
- Each mechanic represents and is responsible for maintaining any license, registration, certification and insurance required by state or local law to perform automotive repairs, and for complying with applicable regulations (including, in Pennsylvania, the automotive repair provisions of 37 Pa. Code § 301 and unfair trade practices law).
- Mechanics must be verified on the platform and meet quality and safety standards.
- If a customer files a chargeback or dispute on an order, the mechanic who performed it is responsible for the disputed amount; FixPit may deduct it from their pending or future payments, or reverse the transfer already made.
5. Pricing and payments
- The price shown when you choose a service is an initial estimated price. The final price may vary based on diagnosis and the work required.
- Before work begins, the mechanic presents a quote that you must authorize. The final price is not charged without your prior authorization.
- Payments are processed securely within the app through our payment provider (Stripe). The charge is made upon completion of the service, based on the authorized price.
6. Cancellations
Cancellations are governed by the policies shown in the app at the time of the request. Some late cancellations may incur charges.
7. Refunds and disputes
If you are not satisfied with a service, contact us within 7 days of its completion and we will review the case. Refunds are evaluated based on the circumstances and, where appropriate, credited to the original payment method. As FixPit is an intermediary, disputes about the work itself are resolved primarily between the customer and the independent mechanic; FixPit may mediate and apply refunds or payment holds at its reasonable discretion.
8. Warranties and disclaimer
FixPit is provided "as is" and "as available," without warranties of any kind, express or implied, to the extent permitted by law. FixPit does not warrant that the platform will be error-free or uninterrupted, and does not endorse any particular mechanic's work. Any warranty on the repair, if any, is provided by the independent mechanic, not by FixPit.
9. Limitation of liability
To the maximum extent permitted by law, FixPit shall not be liable for indirect, incidental, special or consequential damages, nor for damages arising directly from the work performed by independent mechanics. FixPit's total liability for any claim is limited to the amount of the commission FixPit received for the related order.
10. Indemnification
You agree to indemnify and hold harmless FixPit, its owners, officers and collaborators from claims, damages or expenses (including attorneys' fees) arising from your use of the platform, your breach of these terms or, in the case of mechanics, the service you provide through FixPit.
11. Dispute resolution — Arbitration and class action waiver
Any dispute relating to FixPit will be resolved through binding individual arbitration, and not in court or before a jury. You waive the right to participate in class actions. This clause does not prevent you from bringing a claim in small claims court where applicable. You may opt out of this arbitration clause by notifying us in writing within 30 days of your first use of the platform.
12. Governing law
These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. Subject to the arbitration clause above, the forum for any dispute shall be Philadelphia County, Pennsylvania.
13. Changes to these terms
We may update these terms. We will notify you of important changes through the app or website.
